Terms of Service

These terms form a binding agreement between you and ThynkPay Limited ("ThynkPay", "we", "us", or "our"). Please read them carefully — by using ThynkPay you agree to them.

1. Acceptance of these terms

By creating a ThynkPay account, or by accessing or using the ThynkPay website, mobile applications, or any related service (together, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, you must not use the Service.

These terms should be read together with our Copyright Notice and any product-specific terms we present to you in the app.

2. Eligibility

To use ThynkPay you must:

  • Be at least 18 years old.
  • Be a resident of Nigeria with a valid Nigerian phone number.
  • Be able to form a legally binding contract under Nigerian law.
  • Provide accurate identity information and, where required, complete identity verification.

We may decline to open an account, or close an existing one, if you do not meet these requirements.

3. Your account

You are responsible for the activity that happens on your account and for keeping your phone, one-time passwords (OTPs), and device secure. You agree to:

  • Give accurate, current, and complete information.
  • Keep your contact and identity details up to date.
  • Never share your OTP, and never let anyone else transact on your account.
  • Tell us immediately at info@thynkpay.com if you suspect unauthorised access or fraud.

4. Wallet & banking partner

ThynkPay is a technology platform, not a bank. Funds in your ThynkPay wallet are held with our licensed banking partner, Providus Bank, under applicable Central Bank of Nigeria (CBN) regulations. Your wallet balance reflects funds held on your behalf at the partner bank.

We are not a deposit-taking institution and do not pay interest on wallet balances. The availability of banking features depends on our partner bank's systems, which may occasionally be unavailable for maintenance or reasons beyond our control.

5. Payments, transfers & cash-outs

The Service lets you receive payments via QR code, send money to other users, and cash out to Nigerian bank accounts. You authorise us, and our banking partner, to carry out the transactions you instruct.

  • Transactions are generally irreversible once completed. Check the amount and recipient before you confirm.
  • We may apply daily and per-transaction limits based on your verification tier and on regulatory requirements.
  • We may delay, hold, or decline a transaction where we reasonably suspect fraud, error, or a breach of these terms or the law.

6. Fees

Registration is free. We charge a small fee on certain transactions; the applicable fee is shown to you before you confirm a payment or cash-out. We may change our fees from time to time and will give you reasonable notice of any change. Continued use of the Service after a fee change takes effect means you accept the new fees.

7. Identity verification (KYC)

Nigerian law requires us to verify the identity of our users. You agree to provide your Bank Verification Number (BVN), date of birth, and any other information we reasonably request to satisfy Know-Your-Customer (KYC) and anti-money-laundering obligations. We may limit or suspend your account until verification is complete.

8. Acceptable use

You agree to use ThynkPay only for lawful purposes and in line with these terms. You are responsible for ensuring that the payments you send and receive are for legitimate goods and services.

9. Prohibited activities

You must not use ThynkPay to:

  • Launder money, finance terrorism, or move the proceeds of crime.
  • Engage in fraud, scams, or any deceptive or unauthorised transaction.
  • Sell or pay for anything illegal under Nigerian law.
  • Impersonate another person or business, or misrepresent your identity.
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems.
  • Interfere with, disrupt, or place undue load on the Service or its infrastructure.

10. Suspension & termination

We may suspend or terminate your access to the Service, with or without notice, if you breach these terms, if we are required to by law or our banking partner, or if we reasonably believe your account poses a fraud, legal, or security risk. Where the law allows, we will tell you why.

You may close your account at any time. We may retain certain information after closure where we are required to for legal, regulatory, or fraud-prevention reasons, as described in our Privacy Policy.

11. Disclaimers & liability

The Service is provided "as is" and "as available". To the fullest extent permitted by Nigerian law, we exclude all implied warranties and we are not liable for indirect, incidental, or consequential losses, or for loss of profits, goodwill, or data.

Nothing in these terms limits liability that cannot be limited under Nigerian law, including liability for fraud or for death or personal injury caused by negligence. Where we are liable, our total liability to you is limited to the fees you paid us in the three months before the event giving rise to the claim.

12. Disputes & governing law

These terms are governed by the laws of the Federal Republic of Nigeria. We would always rather resolve a problem informally first, so please contact us at info@thynkpay.com before taking any formal step. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

13. Changes to these terms

We may update these terms from time to time. When we do, we will revise the "Last updated" date above and, where a change is material, take reasonable steps to notify you in advance — for example through an in-app message, a banner, or an email. Continued use of the Service after a change takes effect means you accept the updated terms.
